Here’s the link for the LA Times story about the citation:  http://www.latimes.com/la-me-uclalab5-2009may05,0 ,7130412.story

Here’s a quote from the article that may be illuminating:

<"The important point to make here is that these penalties are not designed to compensate for injury or loss of life," said Dean Fryer, a Cal/OSHA spokesman, explaining that the fines <merely address the civil violation s of workplace regulations.

<As in any accident resulting in death, Fryer said, Cal/OSHA will prepar e an additional report to present to the Los Angeles County district attorney fo r consideration of criminal prosecution. <Cal/OSHA as a matter of routine does not contact the district attorney before civil penalties are assessed.

Stay tuned – more to come, I thi nk.

OSHA cannot cite for the fatality, only for the hazards that caused it. Besides each citation can only go up to $7 ,000 unless its a willful citation (plain indifference or intentional disregard) . I think our NATIONAL average for cases that involved fatalities for last year was ~ $3500.  This could be very frustrating and I know it seems like very little, but that's the way it wor ks.

Guys, < /font>

This is shamef ul! $31850 for a fatality. We would get fined double that for an explosion. Foster’s group recently got fined over $1,000,000 for an occupational fatality when they had not installed a failsafe they were instructed to do by Worksa fe (our equivalent of OSHA) on a previous inspection.  Admittedly it was a million AUS $.

Cal OSHA issued its citations on t he UCLA fatality at 16h30 Monday 4 May.

Cal OSHA fined UCLA $31850 for the fatality.  $18,000 was for inadequate use of PPE, most of the remainde r was for lack of training.

No surprises in the citation.
