Today, the U.S. Environmental Protection Agency (EPA) is releasing guidance on the two petition processes applicable to the Toxic Substances Control Act (TSCA) Chemical Data Reporting (CDR) regulations for public comment. This guidance is designed to help the regulated community understand and comply with the requirements of both CDR-specific petition processes. Under the CDR rule, stakeholders can submit: - petitions for full exemption of byproduct substances that are recycled or otherwise used within site-limited, physically enclosed systems; and
- petitions for partial exemption of chemicals for which the CDR processing and use information has been determined to be of "low current interest" by the agency.
Petitions to be considered for the next CDR submission period in 2024 are due to EPA before January 1, 2022. The proposed guidance released today includes information on: - The procedure for submitting a petition including the regulatory requirements and deadlines.
- The requirements and/or considerations of both types of petition processes.
- The types of information petitioners could provide to EPA that may help demonstrate that exemption criteria and the requirements and/or considerations are met.
- How to submit confidential information and assert a confidentiality claim in a petition.

The CDR rule requires manufacturers (including importers) of certain chemical substances listed on the TSCA Chemical Substance Inventory to report data on chemical manufacturing, processing, and use every four years. This information helps EPA understand exposure to these chemicals and screen and prioritize chemicals to identify and evaluate potential human health and environmental effects.
