I did some checking, and I got two responses. One response was from Virginia, "There is no variance. I have spoken to several folks in OSHA to confirm this. ALL police personnel must undergo a physical screening prior to being fit tested. We fit test on an annual basis using the PortaCount fit testing machine. We conform to all regulations in OSHA 1910.134." and also from the national emergency center. They said that if the state has a state OSHA, they may grant a variance, but all federal OSHA states must conform. There is no requirement for the 15-minute, full-head emergency escape respirators. Hope that settles the issue.
