However, there may be a Cal-OSHA requirement. From the federal OSHA standpoint, you would need to provide some assurance that the air contaminant exposure limits were not exceeded. In a typical office building you would not expect that to happen unless there was "something" going on that was pretty unusual. There must be a reason why the custodians are complaining and it would be worthwhile to get at the reason for their concern. If there is no good reason for operating the ventilation during the early morning hours, you could just say "no". However, there may be an opportunity for compromise such as slowly bring the system online or starting its operation a little earlier. Sometimes the politics determines the most acceptable path.
